Terms and Conditions of the Participation in the Central European Urology Meetig (CEM 2023)

I. Definitions
The terms used in these terms and conditions written in capital letters shall have the following meaning:

Terms and Conditions - these terms and conditions forming the content of the Agreement on the participation in the Conference.
Agreement - depending on the scope of the Participant’s registration: the agreement on the participation in the Conference or any part thereof concluded between the Organizer and the Participant..
Conference Executive Organizer - the Conference organizer, i.e. ZiZ Centrum Edukacji sp. z o.o. with its registered office in Kraków, address: 31-131 Kraków, ul. Garbarska 13/3, NIP 675-144-18-83, REGON 121417864, entered in the register of entrepreneurs of the National Court Register maintained by the District Court for Kraków Śródmieście District in Kraków, XI Economic Division of the National Court Register under No. KRS 0000372884, with the share capital of: PLN 58,000.00.
Conference Scientific Organizer - Fundacja Urodzeni Zdrowi with its registered office in Kraków, address: 31-531 Kraków, ul. Grzegórzecka 18, NIP 675-170-82-86, REGON 383819737, entered in the register of associations under No. KRS0000793169.
Conference - Central European Urology Meetig (CEM 2023) to be organized by the Organizer on 24-25.03.2023 in Kraków, in w CKF_13 Conference Center Fabryczna, ul. Fabryczna 13, 31-553 Kraków. The Conference is intended for persons authorized to issue prescriptions or persons involved in the trade in medicinal products.
Participant - a person participating, according to these Terms and Conditions, in the Conference or any part thereof, regardless of their status.
Urologist - specialist in urology (and other specialties) / a Participant authorized to issue prescriptions or involved in the trade in medicinal products.
Resident - urologist in-training / a Participant authorized to issue prescriptions or involved in the trade in medicinal products, who is in the process of obtaining their medical specialty.
Consumer - a natural person engaged in a legal transaction with an entrepreneur not related directly to their business or professional activities.

II. Parties to the Agreement

The Participant only may be a party to the Agreement on the participation in the Conference.

III. Entering into the Agreement — the registration

The Agreement shall be concluded upon the performance of the following activities described in the Terms and Conditions:
1. the completion of a valid registration confirmed by the Conference Executive Organizer and
2. the payment of the full conference fee.
The registration for the participation in the Conference shall only be possible through the online registration form available at: https://cem-uro.com The online registration shall be available until March 15th, 2023.
The Conference Executive Organizer reserves the right to terminate the registration before the said deadline when all the available entries are made. The information about the termination of the registration shall be published by the Conference Executive Organizer at https://cem-uro.com.
The online registration may be carried out only by the Participant personally as regards their participation in the Conference.
In order to register, you must provide all the information required by the registration system, i.e.:
1. first name and last name;
2. country;
3. phone number;
4. the e-mail address which, following the correct registration, will become the contact address for communication with Conference Offic
The e-mail address provided in the registration process shall be used to: confirm the registration; confirm the receipt of payments; send reminders of the registration and payment deadlines; and to send information relating to the organization of the Conference.
The registration acknowledgment shall be sent automatically by the registration system following the proper registration. If you do not receive the confirmation of the registration within 5 days from the time of such registration, you should contact the Conference Executive Organizer to check whether the registration was correct.

IV. The Conference program

Planned program objectives of the Conference are published at https://cem-uro.com.

V. The conference fee

The conference fee shall depend on the Conference Participant status and the date of the full payment for their participation in the Conference in accordance with the fee specification below:
Till March 3rd, 2023

Urologist (and other specialties) - € 70
Resident - € 20

Till March 15th, 2023
and registration on site

Urologist (and other specialties) - € 100
Resident - € 50
The conference fees presented above include Polish VAT.
The entity paying for the conference fee (the Participant) shall cover independently any and all costs, fees and charges due to third parties for the making of payments, including but not limited to the costs of international bank transfers.
If the amount of the conference fee booked in the Organizer’s bank account is lower than the amount provided above (in section V.1), the Participant shall pay to the Organizer, within 7 days from the call to do so, the missing amount of the fee which was due on the date of the first payment. Otherwise, the Participant shall have to make a supplementary payment to ensure the payment of the full conference fee applicable on the date of supplementing the original payment.
The amount of the fee shall depend on the time of its payment and not on the time of the registration.
The conference fee for the Urologist (and other specialties) and the Resident includes:
1. Participation in scientific sessions, workshops and medical exhibition
2. Certificate of participation
3. Catering on March 24th, 2023 – coffee break
4. Catering on March 25th, 2023 – 2 coffee breaks and lunch
5. The conference fee shall depend on the Conference Participant status and the date of the full payment for their participation in the Conference in accordance with the registration fee specification above. Below: (in section V.1),
Only Participants who registered for CEM 2023 and paid the required fee are entitled to participate in the chosen workshop ( there is no additional fee for workshops) subject to availability of places.Due to the nature of workshops there is a limited number of places for each workshop and so the registration for workshops shall undergo the following conditions:Only Participants of CEM 2023 are entitled to participate in workshops.Participant can, as part of the conference fee, participate in 1 workshop only after choosing the proper option while registering for the Conference, subject to availability of places and after completion of all the required formalities of CEM 2023 registration and participation.
The date of posting of the required registration fee on the Organizer’s bank account is crucial when qualifying for workshop participation.
The Conference Executive Organizer shall not provide services other than the services indicated directly in the Terms and Conditions, particularly it shall not provide accommodation, individual hotel bookings, tours, other trips and, therefore, they are not covered by the conference fee, and also, as a result, the Conference Executive Organizer shall not be responsible for their provision (including the provision of services only recommended by it).
The payment for the participation in the Conference may be made as follows:

4. by credit card during the Conference — only for payments accepted as “on-site registration”.
  
  In case of a payment by the bank transfer, the Participant is obliged to pay within 7 days after entering into Agreement (making a registration through the online registartion form) as well as to send the confirmation of bank transfer immediatelly by e-mail to contact@cem-uro.com. In case of an on line payment by the credit card or mobile payment, the payment is finalised during the registration proces.
The Participant shall be liable for making a correct bank transfer including in the title of the payment “CEM 2023” and the first name and last name of the Participant for whom the payment is made.
After March 15th, 2023, the conference fee may be paid only on site during the Conference.
The participation in the Conference shall be possible only upon the presentation of the conference ID.

VI. Cancellation of the participation in the Conference

A registered Participant in the Conference may cancel their participation without giving any reasons for the cancellation.
The cancellation of the participation must be sent in the form of a scanned copy of a withdrawal declaration ( Appendix 1 ) signed by the Participant to the e-mail address: contact@cem-uro.com The cancellation e-mail should be sent from the e-mail address provided during the registration process.
In case of the cancellation received by the Organizer:
1. prior to February 28th, 2023, the Participant shall receive the refund of 80% of the conference fee ( all the bank’s provisions are to be paid for by the Participant)
2. after February 28th, 2023, the Participant shall not be entitled to a refund of any part of the conference fee.
  The provisions of (VI.3.1) and (VI.3.2) shall not apply to Consumers who are subject to general provisions of the Polish law.
The conference fee shall be refunded:
1. in the case of a bank transfer — to the bank account provided by the Participant. All the information needed for an international bank transfer shoul be sent to the following e-mail address: contact@cem-uro.com
2. in the case of a credit card payment and mobile payment - the refund shall be made with the same method as the payment.
If the conditions for the refund of fees are met, such a refund shall be made in the period of up to 8 weeks following the termination of the Conference. The foregoing shall not apply to Consumers who are subject to general provisions of the Polish law.

VII. Personal data

The Data Controller of the Participant's personal data is:

The provision of personal data contained in the registration form is voluntary, but necessary for participation in the Conference.
Consent to the processing of personal data for marketing purposes is voluntary.
The personal data provided will be processed for: taking part in the Conference ( including the creation of an account) on the basis of Article 6(1)(b) of the GDPR;
1. the fulfilment of a legal obligation incumbent on the Data Controller (tax returns), on the basis of Article 6(1)(c) of the GDPR;
2. pursuing a legitimate interest of the Data Controller of the personal data, in particular to assert or defend against possible claims, on the basis of Article 6(1)(f) of the GDPR;
3. direct marketing of the Data Controller's own services or those of third parties, but only if the Participant has given separate consents to this effect during registration (Article 6(1)(a) of the GDPR);
The Participant's personal data will be shared with:
1. subcontractors of the organiser for the purposes of the Conference, including services of a subcontractor providing an online registration system used to register for the Conference (Mobile Madness Sp. z o.o., ul. Jana Twardowskiego 3 / 35, 35-302 Rzeszów, KRS 0000709762, REGON 368993527, NIP 813-376-58-46) , Przelewy24 (PayPro S.A. ul. Kanclerska 15, 60-327 Poznań, NIP 779-236-98-87, REGON 301345068)
  in case of payment through it, as well as accounting, legal or IT services of the Organiser,
2. in the event that the Participant gives the relevant consent during registration for marketing, the data may be made available, depending on the scope of the consent given, to other entities cooperating with ZiZ Centrum Edukacji sp. z o.o. with its registered office in Kraków, whose activities are related to the medical or pharmaceutical industry.
Personal data processed:
1. in order to participate in the Conference will be processed for the duration of the Conference and thereafter until the expiry of the statute of limitations for civil law claims, as well as for the period required by tax law,
2. in the case of consent to marketing activities, until it is revoked,
The participant has, to the extent and in accordance with the principles set out in the GDPR, the right to access the content of his/her personal data and the right to rectify, erase, restrict processing, the right to data portability, the right to object, the right to withdraw consent at any time without affecting the lawfulness of the processing carried out on the basis of consent before its withdrawal.
If it is found that the processing of personal data violates the provisions of the GDPR, you can lodge a complaint with the President of the Office for Personal Data Protection.
Participant's personal data will not be processed for the purpose of automated decision-making, including profiling.
Personal data will not be transferred outside the European Economic Area.

VIII. Final terms and conditions

In the case of the cancellation of the Conference for reasons attributable to the Conference Executive Organizer, the entire registration fee shall be refunded to the Participant within 14 days. In the case of Consumers, general provisions of the Polish law shall apply.
The Organizer reserves the right to change the rules of organizing the Conference due to force majeure (including the COVID-19 epidemic).
The Organizer will notify the Participants about the change in the rules of organizing the Congress via e-mail, to the address provided during registration, as well as by placing an announcement on the website https://cem-uro.com.
The Organizer reserves the right to change, for important reasons, the program of the Conference.
To the extent permitted by Polish law, the Conference Executive Organizer hereby disclaims its liability for damages to the Participants related to the organization, holding, cancellation or postponement of the Conference. The Conference Executive Organizer shall not be liable for the benefits lost by the Participants in this respect. In the case of the aggregation of claims arising from contractual damage and tort, the Participant may request the remediation of the contractual damage only within the limits provided for above. In the case of Consumers, general provisions of the Polish law shall apply.
The Participants shall comply with fire safety and OHS regulations.
The Participants shall be liable for their (personal) belongings at the Conference venue.
The Participants shall remedy damage made by them pursuant to general provisions of law.
The matters not governed by these Terms and Conditions shall be subject to the Polish law.
